In accordance with the Law on the Protection of Personal Data No. 6698 (“Law”), as the “data controller”, Solar3 Giga Watt Association (“Solar3GW”), in order to fulfill our disclosure obligation arising from Article 10 of the Law, we hereby present the following issues to all stakeholders with this Disclosure Text. This Disclosure Text is valid for all interested parties who fill out the Association Membership Form and all personal data provided to Solar3GW through the Membership Form and the Site. We would like to emphasize that by filling out the membership form and/or information form, you have read, reviewed and will be deemed to have accepted the content of the Disclosure Text on the Protection of Personal Data.
- Data Controller:
In accordance with the law, your personal data is processed by Solar3 Giga Watt Association (“Solar3GW”) as the Data Controller within the scope explained below.
- Methods and Legal Reasons for Collecting Personal Data:
Our Association collects your personal data through the Membership Form or Information Form filled out by you and available on our Association website, through e-mail, post, and other communication channels, in accordance with the personal data processing conditions specified in the Law and in direct proportion to the purposes specified below, primarily for the purposes of carrying out your membership transactions and ensuring compliance of activities with the legislation, in accordance with Article 5 of the Law and the legal reasons specified below.
- How Your Personal Data Is Processed:
Any data belonging to you that has been obtained/will be obtained by Solar3GW as the Data Controller in accordance with the Law or that you have shared or will share with Solar3GW will be processed by Solar3GW only within the scope explained below and in the ways stipulated in the Law.
As the data controller, Solar3GW will process your shared personal data in accordance with the Law and relevant legislation, in order to complete the membership transactions in the most effective way, to develop these transactions, to ensure the uninterrupted continuation and efficiency of the membership relationship and/or to bring members and third parties together; to carry out activities in line with the purposes and work subjects specified in the Association Charter; to organize, manage and carry out activities and related processes for the Association members or representatives such as the Association’s general assembly meetings, working group meetings, summits, agenda meetings, other member meetings; to ensure communication between the Association and members on issues related to membership rights and obligations and to fulfill the relevant rights and obligations; to carry out internal reporting activities of the Association, and for other legal reasons stipulated in other legislation, in accordance with the Law and relevant legislation, and in the ways specified in the Law and this Disclosure Text. Your personal data will be stored only for the purposes specified in this article and/or as long as it is mandatory in accordance with the relevant law and legal legislation.
In addition to being a member of the association or a real person representative of a legal entity member, if you take office in the association bodies, your Identity Information, Contact Information and professional knowledge will be shared with the Provincial Directorate of Associations and other relevant public institutions and organizations for legal reasons, as it is mandatory for Solar3GW, the data controller, to fulfill its legal and statutory obligations in order to fulfill various obligations in the Associations Law and secondary legislation.
Your personal data obtained within the scope of the Solar3GW Law and other legislation as the data controller is limited to the personal data requested in our Membership Form and can be obtained, recorded, stored, kept, preserved and changed by filling out this form by you and in the ways stipulated in the Law.
- Persons and/or Organizations to Which Your Personal Data May Be Transferred:
For the purposes specified in the Law and this Information Text, the persons/organizations to whom your personal data that you share with Solar3GW may be transferred within the scope of the Law in accordance with the “need to know” and “need to use” principles are as follows:
- all official authorities and institutions,
- For the purpose of carrying out our activities, our relevant business partners, consultants and service providers, banks, financial advisors,
In addition, your personal data may be transferred to our business partners and service providers who provide, operate or provide services for our IT infrastructure, to lawyers and other consultants for the purposes of carrying out litigation/enforcement follow-up processes, to our business partners who provide private integrators, independent auditing, customs, financial advisor/accounting services, to legally authorized public institutions and private persons or organizations and third parties, to lawyers, auditors, forensic computer experts, cyber security consultants, tax consultants and other third parties and business partners from whom we receive consultancy and service within the scope of fulfilling legal obligations, to regulatory and supervisory institutions and other official institutions such as courts and enforcement offices, to other public institutions or organizations authorized to request your personal data, and may be processed domestically, limited to the purposes specified in this disclosure text.
- Data Processing Without Explicit Consent
Pursuant to Article 5 of the Law, Solar3GW may process your personal data, which is specified above and received in accordance with the Law, without your explicit consent in the following cases:
- In cases where it is clearly stated in the laws,
- If you are unable to give your consent as a data owner due to a de facto impossibility or if your consent is not legally valid and the processing of your personal data is necessary to protect your life or the physical integrity of someone else,
- If data processing is necessary for the establishment, exercise or protection of a right,
- If data processing is necessary for the legitimate interests of Solar3GW, provided that it does not prejudice your fundamental rights and freedoms.
- Your Rights Under Legislation
By applying to Solar3GW in accordance with Article 11 of the Law;
- To learn whether your personal data is being processed,
- Request information if your personal data has been processed,
- To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
- Knowing the third parties to whom your personal data is transferred,
- Request correction of your personal data if it is processed incompletely or incorrectly,
- Request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Law,
- To request that the operations carried out in accordance with clauses (d) and (e) be notified to third parties to whom your personal data has been transferred,
- To object to a result that is to your detriment as a result of the analysis of processed data exclusively through automated systems,
- To request compensation for damages in case you suffer damages due to the unlawful processing of your personal data,
You have the rights.
You can use your rights under this article and your requests for updates and changes to your personal data by applying to Solar3GW via a notary and/or by contacting Solar3GW at [email protected], provided that your identity has been verified.
Solar3GW will finalize your request free of charge as soon as possible and within thirty (30) days at the latest, depending on the nature of the request. However, we would like to inform you that if the requested transaction requires an additional cost, we will charge the fee determined by the Personal Data Protection Board within the scope of Article 13 of the Law.
